Vonage Hit With Another Law Suit

Vonage has turned into an easy target for competitors and rival technology companies. Previously sued by Verizon over alleged patent infringement, the company is now being sued by ET Klausner Technologies Inc. over its Internet voicemail services, alleging patent infringement and seeking damages and royalties of $180 million.

Klausner, controls patents covering Voice over Internet voicemail -- an important feature of the Vonage service. It reportedly has recently granted AOL a license under the same patent for Internet voicemail services.

Vonage has proven to be quite vulnerable since its initial success and its subsequent disappointing public share offering.

Arby's Ad Campaign Mocks Chicken Rivals

According to a report in Wall Street Journal the fast food chain Arby's has unveiled a new series of ads that mocks the quality of chicken served by rivals McDonald's and Wendy's.

The ads, claim their chicken is 100% all natural chicken while their competitors are using chicken that is only 70% "pure". The report says the ads show a young man standing before the executive board of the rivals' companies, appealing to them to use all natural chicken. The young man is then laughed out of or thrown out of the room depending on the ad.

According to the WSJ Arby's is the 12th largest fast-food operator by sales. McDonald's is the biggest market player while Wendy's is the third biggest. Arby's advertising budget is $98.6 million compared to $770 million for McDonalds and $383.1 million for Wendy's.

Warnings About Cell Phones and Lightning

A 15-year-old girl was struck by lightning while using her cell phone in a London park last year. Some doctors and health advocates are warning against the outdoor use of the devices during storms.

Because she suffered cardiac arrest when struck the girl has no memory of the incident. She survived the strike, but is confined to a wheelchair, has lost some hearing in the ear she was holding the phone to, and suffers a variety of physical, cognitive and emotional problems.

Three British doctors writing in the British Medical Journal warned of cell phone use during lightning storms. "This rare phenomenon is a public health issue, and education is necessary to highlight the risk of using mobile phones outdoors during stormy weather to prevent future fatal consequences from lightning-strike injuries related to mobile phones."

But other experts dispute these conclusions, pointing to other variables that may have caused the incident.

John Drengenberg manager of consumer affairs at Underwriters Laboratories Inc., said "I am not aware of any research on a cell phone being a particular attractor of lightning. There's nothing that would indicate they would attract lightning other than the fact that this girl with her cell phone and antenna would be something that would be the only thing that lightning would go to in that area."

Those who warn of the dangers suggest that the proximity of the conductive materials in the phone would disrupt the "flashover" effect caused by the skin in normal lightning strikes. A person's skin is quite resistant to electrical conductivity and usually prevents serious damage to the interior of the body. But "flashover" can result in greater damage and more deaths.

In spite of this convincing sounding theory, the group could find only three other instances where death or serious injury resulted from a lightning strike while using a cell phone.

Experts generally warn against using any electrical appliance during a thunderstorm, including landline phones and household appliances.

Microsoft adCenter Gets Good ROI But Still Lacks Traffic

After more than a year of testing Microsoft unveiled AdCenter this May. Initially about 2000 advertisers were using AdCenter and this number is up to about 10,000, according to a report by search marketing firm Did-it.com

Microsoft AdCenter is an alternative to Google Adwords and Yahoo Search Marketing, formerly known as Overture.

Initial reports are that AdCenter has a slightly better ROI than either Yahoo or Google. This is primarily because of lower costs. Since MSN has a significantly lower volume of searches, keywords cost about 30% less than Google.

Users report getting about 10% of the volume of clicks with adCenter as compared to Google.

Research has shown good quality traffic with slightly higher conversion rates on the MSN service. adCenter also provides more sophisticated audience targeting tools, and, according to some analysts, a more user friendly interface.

Because adCenter's demographic data is based on millions of people who have signed up for Microsoft Passport, adCenter tends to be more effective at servicing the business to consumer target market.

Ten Design Mistakes to Avoid, by Will Hanke, Lighthouse Technologies

Avoid these mistakes and your site will be steps ahead of your competition.

1. Not planning your site
Before you even have a website, you must have an idea, a focus. Why do you want a website? What are your plans and goals for the site? Sit down and draw out a map of possible pages and ideas for your site. Include your site's purpose --whether it is to sell more product or make the public more aware of your issue -- whatever it may be. Build your site from it's strong foundation (your goals) and you'll have a better, more solid site.

2. Failing to put contact information in a plainly seen location.
This could be disastrous. If a customer doesn't see this information, they can't contact you. You should consider a 'Contact Us' button or link from your Home page. Even better, make a link to your email address in your header or footer, somewhere that will show up on every page. Even if no one ever contacts you this way, just the presence of this information comforts edgy customers.

3. Broken Links
Do you enjoy clicking on a search result only to get a Page Not Found Error? No one likes them. Check your site statistics at least once a month (if not more) to make sure you don't have bad or broken links.

4. Outdated Information
A sure turn-off to a potential customer is the presence of old information. If it's July and your website is announcing the 'new' products available in February, your site just lost major credibility. Make sure your information is up-to-date. Consider adding a 'Whats New' button or a Business Blog.

5. Too Many Font Styles and Colors
This is a huge pet-peeve of my company. I've had people ask me to review their website and the first thing I notice is 4 different fonts. It looks bad, unorganized and unappealing. Different colors may attract the eye for a short time, but constant flashing or otherwise bright fonts (and graphics!) become annoying. Beware, this is a sure-fire way to scare people away from your site!

6. Orphan Pages
Every website has a heirarchy, a sort of tree that branches out from the Home Page. While most of your visitors visit you through your home page, there are times when a page further down interests someone, and they may copy that link and send it to a friend. This is where you need to pay attention. That friend may like what you have to offer, but they can't find out how to contact you, or how to get back to your Home Page. That's an orphan page. Every page on your site should, at a minimum, have a link back to your Home page. I would suggest adding a contact link at minimum.

7. Frames
Frames at one time were the talk of the industry. They were the original Content Management System (CMS) for your site. Nowadays they are few and far between. If you are designing a site, don't use frames. Newer technologies such as server-side includes are much more common and accepted. Your pages look fresher and those silly bars don't get in the way.

8. Disabling the BACK button and excessive Pop-Ups
Have you been to a website and decided that it wasn't the information you were looking for? When you clicked the BACK button, did you suddenly get a barrage of windows (or, pop-ups) to your dismay? These things rarely actually work, and worse off, the reason you hit the BACK button is because you DIDN'T want any more information from that site. Don't break the BACK button. There are other ways to get your user's attention.

9. Slow loading pages
While personal and hobby sites may normally be slow, there should be no reason for your business or other professional website to be slow loading. Today's Internet surfer won't wait long for information from your site - there are too many others with the same thing! Make sure your pages load quickly. If the server is slow, consider a different host. If your webpages are full of applets or large graphics, consider a page/site redesign.

10. Using Leading-Edge Technology
While the Internet is all about new and fancy stuff, don't be the first to do it. While it may 'look cool' to you, you ultimately need to decide if it actually enhances your user's experience. Do the flashy cartoons make your customer more apt to buy from you? Probably not. How many of your customers have to install a Plug-In just to see your page right? Do they have to upgrade their browser to contact you? Not good. Wait until the technology is either more of a standard or gone - you'll save face with potential and future customers.

Mobile Wallet Not Popular in North America

Consumers Not Excited about Mobile Wallet Concept

According to a recent study by In-Stat, U.S. consumers are lukewarm to the idea of using cell phones as mobile wallets. This is an idea that was being pushed in the 90s as "M-Commerce" -- using cell phones as mobile payment devices. But the current manifestation of the idea sees mobile wallets carrying electronic versions of other things usually found in wallets -- membership cards, loyalty cards, and other forms of identification.

Advocates of the mobile wallet concept include credit card companies, hardware vendors, credit card terminal companies, and traditional wireless companies like Nokia and Cingular. Industry representatives project there may be as many as 25 million wireless subscribers in North America by 2011.

But the survey of consumers found that only about 33% of those surveyed were interested in the idea. 72% of respondents were concerned with the additional fees that would be attached to this service. A smaller, but still very significant, number of respondents were concerned about the potential loss of privacy and security.

Mobile Wallet Idea Big in Japan

The mobile wallet concept was given a large push in 2005 when a number of major Japanese credit card and mobile phone companies formed the Mobile Wallet Alliance. The incentive for such a service is greater in Japan than in the U.S. and Canada because fewer Japanese consumers rely on credit card transactions. The mobile wallet is seen as a replacement for cash -- especially for "micro payments".

Japanese credit card companies and mobile phone companies both see this as a future growth area because it will increase cell phone usage as well as reliance on the credit card infrastructure.

Things are a bit different in North America because use of credit cards is already widespread. So converting customers to cell phone payments does not have the same appeal for North American credit card companies -- they already have the business.

However, other non-credit card payment processors such as PayPal actually do have a vested interest in seeing the mobile wallet payment system move ahead. Paypal, which has developed a massive online presence have an obvious interest in moving into more traditional payment processing areas. They see mobile payments as a way of offering an alternative to consumers and taking business directly away from credit card processing companies -- just as they have done online.

Here is why getting inbound links is the best way to get indexed:

1. Search engines index pages because they have found them by following a link from an already indexed page. The more links you have pointing to your page, and the more significant those links, the faster your page will get indexed, and the higher its ranking for the relevant keywords will be. Theoretically, to get your site indexed, you only need one inbound link from a site that itself regularly gets spidered.

2. "Submitting" your pages to search engines does not remove the necessity to be linked from somewhere. If there are no links pointing to your site, chances are, submission will not help.

3. Once you are indexed, constant submission is not going to help you. What will help you is regular updating of your pages and getting more links. In spite of the popularity of link exchange programs, this is probably the least effective way to get your site indexed. Many webmasters who engage in link exchange programs try to get a valuable link in exchange for a value-less one. More often than not they will put your link on a relatively useless page.

More than a year ago I set up a number of theme-specific article sites where articles and product announcements in specific categories can be posted. Three of them have been gradually building traffic, and the number of posted articles has been steadily growing.

The busiest is Click-Partners.com with a wide cross section of articles in categories such as Health, Real Estate, Marketing, etc.

Another that is gaining ground is Traffic-Advisor.com where the focus is on Marketing and Search Engine topics, although there is also a broad enough selection of categories to satisfy most people.

The third most popular is Trade Show Tips. This site is quite a bit narrower and focuses on trade show marketing.

Who should post at these sites?

Anybody who wants to gain some exposure for your products or ideas should post articles. It's easy and free.

Using Articles to get traffic and impress the search engines

Embedding your links in articles is one of the best methods of rapidly increasing your inbound links. Many times a well-written article will show up in hundreds of places on the web. And if it has your link embedded in it, that will obviously increase your inbound links. Webmasters pick up these articles because they want content to enhance the value of their sites.

Articles will also generate direct traffic because people who read them are already interested in your subject matter, and are therefore more likely to click on your link.

This suggests that the most valuable place to publish your article is in a themed or categorized article resource. For instance, if your product is "health" related, having it published on health-oriented sites will be more valuable than having it published on generic sites.

You can even take this a step further. If your article is about something more specific like mesothelioma advice, then getting it published on sites that focus on "mesothelioma" will get more "reads", and have a greater influence on the search engines.

Second, when embedding your link, try to use anchor text that contains one of your important keywords, not just your URL or web address. Remember that search engines are dumb. Canadian Business to spend more on tech in 2006

Research conducted by IDC reveals Canadian small and medium-sized businesses (SMBs) spend about 42 per cent less per worker on Information and Communication Technology (ICT) than their U.S. counterparts.

While there do exist shining examples of Canadian SMBs using ICT to improve operational efficiencies, studies have also shown that these examples are few and far between.

In 2006, technology companies will assume a greater responsibility in educating the SMB market about the importance of investing in ICT to remain competitive. As a result, a responsive SMB sector -- the just under one-million SMBs (one to 20 employees) that account for 86 per cent of Canadian companies Statistics Canada, Business Register, December 2004 -- will see an increase in business efficiencies and market penetration.

Microsoft getting serious about its Adwords competitor

Microsoft is barely in the search engine contextual advertising game, but they are trying hard to change that. The MSFT services-based strategy that lies behind the feature rich new verison of Windows Live (MSN Messenger) depends on advertising dollars, and so far they haven't found a way to crack the Google and Yahoo stranglehold on this market.

With lots of money and patience, Microsoft has spent more than a year developing and testing adCenter, and it will be formally launched in June, 2006. That's when the MS contract with Yahoo runs out.

According to MSFT, adCenter will have "the ability to deliver fine-grained demographic data -- ages, location, interests." Neither Google nor Yahoo can currently make that claim.

By itself, MSN Search does not provide the critical mass for running successful PPC ad campaigns. But that will be offset by the large subscriber base of other MSN services -- in particular Messenger.

Google Local integrates maps, local product search

Everybody agrees that local search is going to be very big in the next couple of years. Say you're looking for a place to buy an digital camera in a particular city. Just do a search for "digital camera in MyTown", and Google Local will give you a detailed street map of the area along with stores that carry the product, and locations indicated on the map.

Since products are indexed by keyword, you can search for virtually anything, rather than being restricted to the categories pre-defined by a service like the yellow pages.

Also unlike the yellow pages Google Local includes all stores they have a listing for, not just paying advertisers. Local gives you a map with locations, plus listings with links direct to the stores. The potential for this resource seems awesome.

Plus Google Local has integrated a very slick map utility that arguably looks better (simpler) and in some ways works faster than other services such as MapQuest. For instance, you can search for a relatively obscure place like Carlyle, Saskatchewan or Brora, Scotland and you are taken to a detailed street map for the entire region. If you are looking for a broader overview of the area, you can just grab the map and scroll along a highway or the coast without having to click on navigation arrows as you do with MapQuest.

Google has also integrated its satellite imaging service into Local. If you are looking at a specific map and would rather see a satellite image of the area, just click on "satellite". Or if you would like to see the satellite image with a map overlay, you can see that too, by clicking on "hybrid".

Major TV networks putting more shows online

2005 was the year that major TV networks started to seriously dabble in online TV programming.

In October, ABC began to sell downloads of complete, ad-free episodes of top shows like "Lost" and "Desperate Housewives,". Some think this signals the advent of the long-predicted convergence of TV and online.

Since October, several other networks have made shows available through a joint agreement with iTunes. These include Disney, NBC Universal, Sci Fi Channel, and USA Network.

Now CBS is using online distribution to promote two popular comedies "Two and a Half Men" and "How I Met Your Mother." The network will make two complete episodes of each of the Monday night sitcoms available for one week in a deal with Yahoo! The promotion is called the "CBS Comedy Bowl."

Both half-hour shows, were broadcast earlier in the season, and will be streamed ad-free in Yahoo!'s video player. The video player is available from Yahoo! TV. Yahoo TV features TV listings and show previews and is gradually adding new video content.

"We want to be where the viewers are, and this exclusive partnership with Yahoo! gives us the chance to target an expanded online audience for 'Two and a Half Men' and 'How I Met Your Mother' at a time of the year when many potential viewers are home on vacation and surfing the Internet," Nancy Tellem, president of the CBS Paramount Network Television Entertainment Group, said in a statement.

Previous CBS initiatives included a September effort with Google to stream its "Everybody Hates Chris" premiere. Then in October, CBS made audio podcasts of select shows available on iTunes. These include "Survivor Live", "60 Minutes," "Guiding Light," and "NFL Hot Topic."

Earlier in 2005, AOL launched In2TV, a more aggressive broadband video network that will offer episodes of more than 30 classic TV series. Offerings will be available in January and will carry 15 and 30 second video ads. Promotion of this service was one of the major reasons behind the renewed Google/AOL partnership.
